Terms and Conditions for Employer Hospital/Doctor before Registration on IMA Job Portal
These Terms and Conditions govern the use of the IMA Job Portal ("www.imacareers4doctors.com"), for employers (referred to as "Employer," "Hospital," or "Employer Organization") wishing to post job listings for medical professionals. By registering on the Portal, the Employer agrees to abide by these Terms, which form a legally binding agreement between the Employer and the Indian Medical Association ("IMA").

Acceptance of Terms :-
By registering as an employer on the IMA Job Portal, the Employer acknowledges that they have read, understood, and agreed to be bound by these Terms. If the Employer does not agree with these Terms, they must refrain from using the Portal.

Purpose of the Portal
The IMA Job Portal is a platform provided by IMA to help IMA member doctors to find job opportunities in healthcare institutions and hospitals. The Portal facilitates posting of job vacancies by Employers and the application process for member doctors. IMA serves as an intermediary to connect Employers with applicants but does not directly participate in the recruitment process.

Registration and Fees
To use the Portal, Employers must register and create an account. This fee is non-refundable and is payable at the time of registration.
Registration does not guarantee any number of applications or job placements, and IMA is not responsible for the success or outcome of the job postings. -
Employer Responsibilities
By using this Portal, the Employer agrees to:
- Verify Credentials: The Employer is solely responsible for verifying the qualifications, credentials, professional degrees, work experience, and any other relevant documents of the doctors applying for the posted job. IMA will not be responsible for any discrepancies in the qualifications or background of applicants.
- Accurate and Legal Job Listings: Employers must ensure that all job listings posted on the Portal are accurate, legally compliant, and free of misleading or discriminatory language. Employers should adhere to all applicable labour laws, regulations, and ethical standards in their job postings.
- Non-Discrimination: Employers agree not to discriminate on the basis of race, gender, age, religion, nationality, or any other legally protected category in their job listings or hiring practices.
- Confidentiality: Employers must treat all personal and professional information shared by applicants with the highest degree of confidentiality and must not share, sell, or misuse such information.

IMA’s Role and Liability
- No Responsibility for Job-Related Issues: IMA acts solely as an intermediary for job postings and applications. IMA does not guarantee the availability, accuracy, or success of any job application, nor does it assume responsibility for any disputes, contractual issues, or employment-related matters between the Employer and the applicant doctor.
- No Endorsement or Guarantee of Applicants: IMA does not endorse, recommend, or verify the qualifications of any applicants. It is the Employer's responsibility to conduct the necessary due diligence to confirm the qualifications, experience, and professional background of the applicant doctor.
- No Warranty for Accuracy: IMA does not warrant the accuracy, completeness, or timeliness of any job listing, nor does it guarantee that applicants meet the Employer's expectations. IMA is not liable for any discrepancies or issues that may arise between the Employer and the applicant doctor.
- Limitation of Liability: Under no circumstances will IMA be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Portal, including but not limited to issues related to employment contracts, disputes, or malpractice claims.

Employer Content
- Responsibility for Job Listings: The Employer is solely responsible for the content of the job listings posted on the Portal, including job descriptions, qualifications, compensation details, and any other relevant information. The Employer agrees not to post any content that is illegal, offensive, or violates any third-party rights.
- Removal of Listings: IMA reserves the right to remove any job listing that violates these Terms or is deemed inappropriate, misleading, or harmful. IMA does not have any obligation to monitor the content posted by Employers but may take action if necessary.

Application Process
- Applicant Responsibility: Doctors applying for job listings on the Portal are responsible for ensuring that their application and supporting documents are complete, accurate, and up to date. IMA does not verify the content of the applications or supporting documents submitted by applicants.
- Employer’s Interaction with Applicants: Employers are responsible for communicating directly with applicants. IMA does not engage in any part of the interview, selection, or hiring process.

Indemnification
The Employer agrees to indemnify, defend, and hold harmless IMA, its officers, directors, employees, and affiliates from and against any claims, losses, damages, expenses, or legal fees arising from:
- Any violation of these Terms by the Employer.
- Any employment-related disputes or claims between the Employer and an applicant doctor.
- Any inaccurate, incomplete, or misleading job listing posted by the Employer.
- Any failure by the Employer to verify the qualifications or background of applicants.

Privacy and Data Protection
By using the Portal, the Employer consents to the collection, processing, and storage of their data and the personal information of applicants in accordance with IMA’s Privacy Policy. The Employer agrees to comply with applicable data protection laws and ensure that personal data is handled securely.

Termination of Access
IMA reserves the right to suspend or terminate an Employer's access to the Portal if the Employer is found to be in violation of these Terms or engages in fraudulent or illegal activity. Termination will result in the removal of the Employer's ability to post job listings, but it will not affect any pre- existing obligations between the Employer and IMA or the applicants.

Modifications to Terms
IMA may update or revise these Terms at any time. The updated Terms will be posted on the Portal and will take effect immediately. Employers are encouraged to review these Terms periodically. Continued use of the Portal after modifications constitutes acceptance of the revised Terms.

Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising from the use of the Portal will be subject to the exclusive jurisdiction of the courts in Delhi only.
By registering and using the IMA Job Portal, the Employer acknowledges that they have read, understood, and agree to these Terms and Conditions.
